style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">侵害犯罪以外，對他人實施違反其意願而與性或性別有關之行為，且有下列情形之一者：</span></span></p>\r\n\r\n<p align=\"justify\" class=\"註腳文字-cjk\" style=\"margin-left: 2cm; line-height: 0.64cm; text-indent: -1cm;\"><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">(</span></span><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">一</span></span><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">)</span></span><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">以該他人順服或拒絕該行為，作為其獲得、喪失或減損與工作、教育、訓練、服務、計畫、活動有關權益之條件。</span></span></p>\r\n\r\n<p align=\"justify\" class=\"註腳文字-cjk\" style=\"margin-left: 2cm; line-height: 0.64cm; text-indent: -1cm;\"><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">(</span></span><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">二</span></span><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">)</span></span><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">以展示或播送文字、圖畫、聲音、影像或其他物品之方式，或以歧視、侮辱之言行，或以他法，而有損害他人人格尊嚴，或造成使人心生畏怖、感受敵意或冒犯之情境，或不當影響其工作、教育、訓練、服務、計劃、活動或正常生活之進行。</span></span></p>\r\n\r\n<p align=\"justify\" class=\"註腳文字-cjk\" style=\"margin-left: 1.13cm; line-height: 0.64cm; text-indent: -1.13cm;\"><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">三、本要點適用於所屬員工或受服務人員應適用性騷擾防治法之性騷擾行為，但性騷擾行為應適用性別工作平等法或性別平等教育法處理者，不適用本辦法。</span></span></p>\r\n\r\n<p class=\"cjk\">&nbsp;</p>\r\n\r\n<p class=\"cjk\"><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">四、本要點應防治性騷擾行為之發生，建立友善的工作或營業環境， </span></span></p>\r\n\r\n<p class=\"cjk\" style=\"margin-left: 1.06cm;\"><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">消除工作或營業環境內源自於性或性別的敵意因素，以保護員工或受服務人員不受性騷擾之威脅。</span></span></p>\r\n\r\n<p class=\"cjk\">&nbsp;</p>\r\n\r\n<p class=\"cjk\"><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">五、本總隊每年將擇期舉辦或鼓勵人員參與性騷擾防治相關教育訓</span></span></p>\r\n\r\n<p class=\"cjk\" style=\"margin-left: 1.25cm;\"><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">練，並於員工在職訓練或工作坊中，合理規劃性別平權及性騷擾防治相關課程。參加者將給予公差登記及經費補助。</span></span></p>\r\n\r\n<p class=\"cjk\">&nbsp;</p>\r\n\r\n<p class=\"cjk\"><span style=\"font-family: 標楷體, cursive;\"><span class=\"cjk\">&nbsp;</p>\r\n\r\n<p class=\"cjk\"><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">七、於知悉有性騷擾之情形時，應採取立即且有效之糾正及補救措</span></span></p>\r\n\r\n<p class=\"cjk\" style=\"margin-left: 1.25cm;\"><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">施，並注意下列事項：</span></span></p>\r\n\r\n<ol>\r\n\t<li>\r\n\t<p align=\"justify\" class=\"cjk\" style=\"line-height: 0.64cm;\"><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">保護被害人之權益及隱私。</span></span></p>\r\n\t</li>\r\n\t<li>\r\n\t<p align=\"justify\" class=\"cjk\" style=\"line-height: 0.64cm;\"><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">對所屬場域空間安全之維護或改善。</span></span></p>\r\n\t</li>\r\n\t<li>\r\n\t<p align=\"justify\" class=\"cjk\" style=\"line-height: 0.64cm;\"><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">對行為人之懲處。</span></span></p>\r\n\t</li>\r\n\t<li>\r\n\t<p align=\"justify\" class=\"cjk\" style=\"line-height: 0.64cm;\"><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">其他防治及改善措施。</span></span></p>\r\n\t</li>\r\n</ol>\r\n\r\n<p class=\"cjk\">&nbsp;</p>\r\n\r\n<p class=\"cjk\"><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">八、為受理性騷擾申訴及調查案件，本組織成員或受僱人達</span></span><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">30</span></span><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">人以上</span></span></p>\r\n\r\n<p class=\"cjk\" style=\"margin-left: 1.25cm;\"><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">者，於處理性騷擾事件之申訴時，應組成性騷擾申訴處理調查單位，並進行調查。調查單位成員有</span></span><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">2</span></span><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">人以上，其成員女性代表比例不得低於二分之一，並得視需要聘請專家學者擔任調查單位成員。</span></span></p>\r\n\r\n<p class=\"cjk\"><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">本單位亦得設立常設之性騷擾申訴調查委員會處理及調查性騷擾</span></span></p>\r\n\r\n<p class=\"cjk\" style=\"margin-left: 1.25cm;\"><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">案件，委員會並置主任委員</span></span><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">1</span></span></span><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">名，</span></span><span style=\"color: #000000;\"><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">性騷擾申訴處理調查單位或性騷擾申訴調查委員會之調查，得通</span></span></p>\r\n\r\n<p class=\"cjk\" style=\"margin-left: 1.25cm;\"><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">知當事人及關係人到場說明，並得邀請具相關學識經驗豐富者協助。</span></span></p>\r\n\r\n<p class=\"cjk\">&nbsp;</p>\r\n\r\n<p align=\"justify\" class=\"條-字元-cjk\" style=\"margin-left: 1.13cm; line-height: 0.64cm; text-indent: -1.13cm;\"><span style=\"font-size: large;\">九、性騷擾之申訴，應以書面或言詞提出。其以言詞為之者，受理之人員或單位應作成紀錄，經向申訴人朗讀或使其閱覽，確認其內容無誤後，由其簽名或蓋章。</span></p>\r\n\r\n<p align=\"justify\" class=\"條-字元-cjk\" style=\"margin-left: 2cm; margin-top: 0.21cm; line-height: 0.64cm; text-indent: -1cm;\"><span style=\"font-size: large;\">申訴書或言詞作成之紀錄，應載明下列事項：</span></p>\r\n\r\n<p align=\"justify\" class=\"款1-cjk\" large;\">有法定代理人者，其姓名、性別、年齡、身分證統一編號或護照號碼、職業、住所或居所、聯絡電話。</span></p>\r\n\r\n<p align=\"justify\" class=\"款1-cjk\" style=\"margin-left: 2cm; line-height: 0.64cm; text-indent: -1cm;\"><span style=\"font-size: large;\">(</span><span style=\"font-size: large;\">三</span><span style=\"font-size: large;\">)</span><span style=\"font-size: large;\">有委任代理人者，其姓名、性別、年齡、身分證統一編號或護照號碼、職業、住所或居所、聯絡電話，並檢附委任書。</span></p>\r\n\r\n<p align=\"justify\" class=\"款1-cjk\" style=\"margin-left: 2cm; line-height: 0.64cm; text-indent: -1cm;\"><span style=\"font-size: large;\">(</span><span style=\"font-size: large;\">四</span><span style=\"font-size: large;\">)</span><span style=\"font-size: large;\">申訴之事實內容及相關證據。</span></p>\r\n\r\n<p align=\"justify\" class=\"款1-cjk\" style=\"margin-left: 2cm; line-height: 0.64cm; text-indent: -1cm;\"><span style=\"font-size: large;\">(</span><span style=\"font-size: large;\">五</span><span style=\"font-size: large;\">)</span><span style=\"font-size: large;\">申訴之年月日。</span></p>\r\n\r\n<p class=\"cjk\" style=\"margin-left: 1cm;\"><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">申訴書或言詞作成之紀錄不合前項規定，而其情形可補正者，應通知申訴人於</span></span><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">14</span></span><span style=\"font-family: 標楷體, style=\"margin-bottom: 0.21cm; margin-left: 0cm; margin-top: 0.21cm; line-height: 0.64cm; text-indent: 0cm;\"><span style=\"font-size: large;\">十、性騷擾之申訴有下列情形之一，應不予受理：</span></p>\r\n\r\n<p style=\"font-size: large;\">一</span><span style=\"font-size: large;\">)</span><span style=\"font-size: large;\">申訴書或言詞作成之紀錄，未於前條第</span><span style=\"font-size: large;\">3</span><span large;\">本人或其配偶、前配偶、四親等內之血親或三親等內之姻親或曾有此關係者為事件之當事人時。</span></p>\r\n\r\n<p align=\"justify\" class=\"款1-cjk\" style=\"margin-left: 2.5cm; line-height: 0.64cm; text-indent: -1cm;\"><span style=\"font-size: large;\">(</span><span style=\"font-size: large;\">二</span><span style=\"font-size: large;\">)</span><span style=\"font-size: text-indent: 0.79cm;\"><span style=\"font-size: large;\">(</span><span style=\"font-size: large;\">一</span><span style=\"font-size: large;\">)</span><span style=\"font-size: large;\">有前項所定之情形而不自行迴避者。</span></p>\r\n\r\n<p align=\"justify\" class=\"款1-cjk\" style=\"margin-left: 0.71cm; line-height: 0.64cm; text-indent: 0.79cm;\"><span style=\"font-size: large;\">(</span><span style=\"font-size: large;\">二</span><span style=\"font-size: large;\">)</span><span style=\"font-size: large;\">有具體事實，足認其執行調查有偏頗之虞者。</span></p>\r\n\r\n<p align=\"justify\" 0.64cm; text-indent: -1.5cm;\"><span style=\"font-size: large;\">十四、處理性騷擾申訴事件之所有人員，對於當事人之姓名或其他足</span></p>\r\n\r\n<p align=\"justify\" class=\"條-cjk\" style=\"margin-left: 1.59cm; line-height: 0.64cm; text-indent: 0cm;\"><span style=\"font-size: large;\">以辨識身分之資料，除有調查之必要或基於公共安全之考量者外，應予保密。違反者，主任委員應終止其參與，並得視其情節依相關規定予以懲處及追究相關責任，並解除其選、聘任。</span></p>\r\n\r\n<p align=\"justify\" class=\"條-cjk\" style=\"margin-left: 1.5cm; line-height: 0.64cm; text-indent: -1.5cm;\">&nbsp;</p>\r\n\r\n<p class=\"cjk\" style=\"margin-left: 1.69cm; text-indent: -1.69cm;\"><span style=\"font-family: 標楷體, cursive;\"><span style=\"font-size: large;\">十五、性騷擾申訴調查委員會或調查單位應有委員或調查單位成員過半數以上出席始得開會，並應有半數以上出席委員或調查人員之同意始得作成決議，可否同數時取決於主席。</span></span></p>\r\n\r\n<p class=\"cjk\">&nbsp;</p>\r\n\r\n<p large;\">性騷擾事件之調查應秉持客觀、公正、專業原則，給予當事人充分陳述意見及答辯之機會。</span></span></p>\r\n\t</li>\r\n\t<li>\r\n\t<p align=\"justify\" class=\"cjk\" style=\"line-height: 0.64cm;\"><span style=\"font-family: 標楷體,
